Leaked Draft Memo Suggests Supreme Court Will Overturn Roe V. Wade

If the court does decide to vote to overturn the holding, it would prove to be the most consequential abortion decision in over 20 years.

(Fwrd Axis) — In a truly stunning breach of Supreme Court confidentiality, Politico published on Monday night what claims to be a draft memo indicating Roe v. Wade would be overturned in a pending court case later this year.

The Supreme Court has declined to comment on the document, which states justices Clarence Thomas, Neil Gorsuch, Brett Kavanaugh, Samuel Alito, and Amy Coney Barrett all side with Mississippi in its case challenging the 1973 ruling.

The case in question is Dobbs v. Jackson, which has a concern about Mississippi’s 15-week ban on abortion. A final opinion in the case is expected later this Spring or early summer.

“The Constitution makes no reference to abortion and no such right is implicitly protected by any constitutional provision,” Alito wrote.

According to the draft, the court would overturn Roe v. Wade’s holding of a federal constitutional right to an abortion. If the court does decide to vote to overturn the holding, it would prove to be the most consequential abortion decision in over 20 years, leading to questions regarding women’s reproductive health in America.

“[Abortion opponents] note that attitudes about the pregnancy of unmarried women have changed drastically,” the draft memo reads in part.

A poll late Monday showed 48 percent of Republican women do not support Roe v. Wade being overturned and the majority of Americans are in support of keeping the holding intact.

FWRD AXIS News has not been able to independently confirmed the document’s authenticity but Politico says it has authenticated the draft.

The Supreme Court declined to comment on the story.

“The Court has no comment,” Supreme Court spokeswoman Patricia McCabe said in a statement Monday.

A final vote is not expected until late June or early July, it is possible the justices’ final vote and the decision may change.
