Federal Judge Blocks Deployment Of Any National Guard Troops To Portland

Immergut, a Trump appointee, stated that the deployment of troops would violate federal law.

A federal judge in Oregon has blocked the Trump administration from sending federalized National Guard troops from any state to Oregon, the latest setback for President Donald Trump.

In a highly unusual Sunday night virtual hearing, U.S. District Judge Karin Immergut expressed her “troubled” feelings about the administration’s efforts to circumvent her earlier court order prohibiting the deployment of the Oregon National Guard to Portland.

“It seems to me that based on the conduct of the defendants and the now seeking National Guard from Texas to go to Oregon again, I see those as direct contravention of the order that this was issued yesterday,” she said.

Her order on Sunday said conditions in Portland were “not significantly violent or disruptive” to justify a federal takeover of the National Guard.

Immergut, a Trump appointee, stated that the deployment of troops would violate federal law, which allows for the federal takeover of the National Guard in response to an invasion or rebellion, as well as the Tenth Amendment, thereby encroaching on Oregon’s sovereign rights.

“I have demonstrated that it is not appropriate to put in military into Oregon,” she said.

Immergut also denied a request to issue a stay of her order pending appeal.

Before the late-night ruling, Defense Secretary Pete Hegseth said in a memo Sunday that he is calling up to 400 members of the Texas National Guard into federal service in Chicago and Portland.

“On October 4, 2025, the President determined that violent incidents, as well as the credible threat of continued violence, are impeding the execution of the laws of the United States in Illinois, Oregon, and other locations throughout the United States,” Hegseth wrote.

Illinois Gov. JB Pritzker said in a press release Sunday that no federal officials had called him to coordinate the deployment.

“We must now start calling this what it is: Trump’s Invasion,” wrote Pritzker, a Democrat. “It started with federal agents, it will soon include deploying federalized members of the Illinois National Guard against our wishes, and it will now involve sending in another state’s military troops.”
